The official guidance is good. It is also incomplete.

Every US driver in Germany gets the same briefing, and it is sound advice: call 110, secure the scene, never admit fault, fill out the European Accident Statement, take photos, report the accident to the military police within the required time, and contact your own insurance company to start the claim.

Read that list again. There is one thing it does not mention: that German law lets the innocent party appoint their own independent expert to assess the damage – and that in a clear-liability case the other side’s insurer normally has to pay for it. That is not a loophole. It follows from § 249 of the German Civil Code and from settled German case law.

So most people do the only thing they were told to do: they wait for the other insurer’s appraiser. That appraiser is competent – but he is not on your side of the table. Ours is.

How it actually works

Who pays what, and who decides

In Germany every vehicle must carry third-party liability insurance (Kfz-Haftpflicht). If a German driver causes the accident, the claim is settled against that driver’s liability insurer – not against yours. The law of the country where the accident happened applies, so a collision on the B 270 near Ramstein is settled under German rules, whatever your policy says.

Once you file the claim, the insurer’s claims representative reviews the file and comes back to you with an offer of compensation. What that offer contains depends almost entirely on one document: the expert report. It sets the repair cost, the diminished value (merkantile Wertminderung), the loss of use, and – if the car is written off – the replacement value and the salvage value. Every euro of your claim is traced back to that report.

§ 249 BGB, in the official English translation: a person liable in damages “must restore the position that would exist if the circumstance obliging him to pay damages had not occurred“, and where a thing is damaged, “the obligee may demand the required monetary amount in lieu of restoration“. In practice this is why you – not the insurer – decide who inspects your car, which garage repairs it, and whether you repair it at all.

What we bring to your car

The damage that never shows up in the estimate

A modern car is not sheet metal with a computer bolted on. The bumper you hit at 25 mph carries the radar sensor for your cruise control. The windshield carries the camera for lane keeping. The floor pan of an electric car carries 400 volts. An estimate written from photographs cannot see any of that. So we bring instruments, and we write down numbers.

Driver assistance: calibration status

Replace a bumper and the radar behind it has to be re-aimed; replace a windshield and the camera has to be re-taught. We connect our Launch and Hella Gutmann diagnostic testers, read the fault memory and record which systems require calibration. That line belongs in the report – otherwise nobody pays for it, and you drive a car whose lane-keeping thinks the road is somewhere else.

Electric vehicles: 400 volts first

Before anyone touches a damaged EV, the high-voltage system has to be proven de-energised. We use the Bosch BIT 1000 high-voltage insulation tester, and we hold the Hochvolt qualification at level 3S. Insulating gloves, tester and barrier material travel in every one of our vehicles – not in a workshop 30 kilometres away.

The battery gets a measured value

In an EV the traction battery is most of the money. After an impact, “the battery seems fine“ is not a valuation. We run an AVILOO test and put the State of Health into the file as a percentage. That number decides whether the car is repairable, what it is still worth, and what a buyer will pay for it after a PCS move.

Geometry: bent is not a feeling

A side impact often ends in the suspension. We put the car on one of the three lifts in our own inspection hall and run an axle and geometry measurement – camber, toe, offset, in figures against the manufacturer’s tolerance. If it is within tolerance, we say so. We are appraisers; we do not earn a cent from the repair we describe.

POV, plates, insurance

Your car is registered differently. The damage is not.

As a SOFA-status ID cardholder you register your POV through the military Vehicle Registration Office, not through a German Zulassungsstelle. The plates on your car are German plates, but they are issued through the US registry and remain US government property – which is why they have to go back to your registration station when you leave Germany or dispose of the vehicle. And your insurance has to stay in force until that disposal is properly done.

That last sentence matters after a total loss. A written-off car is not simply abandoned at a garage: the plates, the paperwork and the disposal record all have to line up. Our report gives you the two figures the process needs – the replacement value (Wiederbeschaffungswert) and the salvage value (Restwert) – documented, dated and defensible.

USAA, GEICO or a German policy – it changes nothing about your rights

Most people here are insured through USAA’s Europe auto policy, through GEICO’s overseas programme for military members, or through a German insurer directly. Whichever it is, you had to present proof of third-party liability cover – the Insurance Confirmation Card, or a German Deckungskarte – to get your plates.

Here is the part that surprises people: none of that determines who appraises your car when a German driver is at fault. The claim runs against the other driver’s German liability insurer, and German damages law decides what you may claim. Your own carrier is your partner for your own coverage – it is not the authority on the other side’s liability. Talk to your insurer, by all means. Then call an expert who is independent of both.

A German court ruling puts the last point better than we can. What to do after the accident – in order

  1. Secure the scene. Hazard lights, high-visibility vest, warning triangle roughly 100 metres back. Injuries: 112. Otherwise call the German police on 110.
  2. Say nothing about fault. You are obliged to give your name, your local address and your date and place of birth. You are not obliged to explain the accident at the roadside, and you should not.
  3. Photograph everything before the cars are moved. Wide shots, the damage from several angles, the other plate, the final position of both vehicles.
  4. Fill out the European Accident Statement (Unfallmeldeformular) with the other driver and note the officer’s name and the police file number. Sign only what you understand.
  5. Report it as required. Follow your unit’s rules for reporting the accident to the military police or security forces – on post immediately, off post within the required window.
  6. Then call us – before the other insurer’s appraiser arrives. One call is enough. We usually inspect the same or the next working day, anywhere in the KMC.

Our office is in Theisbergstegen, west of Kaiserslautern. We work as mobile appraisers within roughly 150 kilometres of it, which puts the whole Kaiserslautern Military Community inside our normal working radius: Ramstein-Miesenbach, Landstuhl, Kaiserslautern, Vogelweh, Sembach, Miesau, Hütschenhausen, Kottweiler-Schwanden, Weilerbach and the villages in between. Baumholder is on our regular route too.

We come to base housing, to off-post apartments, to the body shop where your car was towed, or to a tow yard. If access to an installation is restricted for us, we simply meet you and the car outside the gate – it costs an inspection nothing to happen in a parking lot.

Frequently asked questions

Am I really allowed to pick my own appraiser?

Under German damages law – § 249 BGB together with long-standing German case law – the injured party may as a rule commission an independent expert to assess the damage, and the cost of that expert is part of the claim against the liable party. The other side’s insurer may send its own appraiser, but you are not required to accept that appraisal as the basis for your claim.

My insurance is USAA (or GEICO). Do I have to use their appraiser?

If a German driver caused the accident, the claim is settled against that driver’s German liability insurer – your own carrier is not the one deciding the amount. Tell your insurer what happened, of course. But the appraisal of your vehicle can be done by an expert who is independent of every insurer involved. Ask us what fits your case before you commit to anything.

Can you come on post, or to base housing?

We come to wherever the vehicle is, and access rules differ from installation to installation. In practice the simplest solution is often to meet at your housing area, at the body shop or just outside the gate. Tell us where the car is and we will find a way to it – it does not have to be driveable.

What if my car is a US-spec import?

We calculate with SilverDAT 3 as a DAT Expert Partner, and US-spec vehicles need extra care: parts prices, availability and the market value of a left-hand-drive US model in Germany are not the same as for the European version. We document how we arrived at the figures rather than pulling a number out of a database and hoping nobody asks.

The other insurer already sent an appraiser. Is it too late?

Not necessarily – as long as the car has not been repaired. As long as the damage still exists, it can still be documented and measured. Call us before the repair starts; once the panel is replaced, the evidence is gone.

How fast can you look at my car, and how fast is the report?

Usually the same or the next working day for the inspection, and typically one to two working days after that for the finished report. If you need it faster because of a PCS date, say so when you call and we will tell you honestly whether it is possible.
