If someone hits your car in Germany, the other driver’s insurance company will call you fast – and they will offer to send their appraiser. You do not have to accept that. Under German law you may appoint your own independent car accident expert (Kfz-Sachverständiger), and that expert works for you. We inspect your vehicle in person – at your home, at your unit, on base housing or at the body shop – and we walk you through every line of the report in English.

German law (§ 249 BGB) gives you the right to choose your own expert. If the other party is fully liable, their insurer normally pays the expert’s fee.

What actually happens after a car accident in Germany?

The Kaiserslautern Military Community is the largest American military community outside the United States – roughly 54,000 service members, DoD civilians, contractors and family members live between Ramstein, Vogelweh, Landstuhl and Kaiserslautern. That means thousands of cars on Autobahn 6, on the B 270 and on the narrow village roads of the Westpfalz. Accidents happen. And then a system starts running that almost nobody explains to you in English.

Here is the short version. In Germany, every driver must carry third-party liability insurance (Kfz-Haftpflichtversicherung). If another driver is at fault, their insurance company pays for your damage – the repair, the loss of value, a rental car or a daily compensation, and the fee for the expert who documents it all. You do not claim against your own policy. You claim against the other side.

And that is exactly where the misunderstanding starts. Within a few hours, someone from the other driver’s insurer will call you. They will be friendly. They will speak English. They will offer to send „a technician“ or „a partner appraiser“ to look at your car at no charge to you, maybe tomorrow. It sounds like service. It is not neutral help. That person is paid by the company that has to pay your claim.

The single most important sentence on this page: you choose the expert – not the insurance company. German law (§ 249 BGB) gives the injured party the right to appoint an independent expert. Step by step

What should you do right now?

If the accident just happened and you are reading this on the roadside: take a breath. Nothing is lost yet. Work through this list in order.

  1. Secure the scene. Hazard lights, warning triangle, high-visibility vest. If anyone is injured, call 112.
  2. Call the police (110) if there are injuries, if the other driver disputes fault, if the damage is significant, or if you are unsure. A police report (Unfallbericht) is not required by law for every minor scrape, but it protects you.
  3. Photograph everything. Both cars, both license plates, the position on the road, skid marks, the intersection, the traffic signs. Wide shots first, close-ups after.
  4. Exchange details: name, address, license plate, insurance company and policy number of the other driver. If they refuse or drive off, note the plate and call the police.
  5. Paperwork at the roadside is still paperwork. A „Schadenanzeige“, or a form handed to you by a tow truck driver or a body shop, is a contract. Nobody can require you to sign a document on the spot that you do not fully understand.
  6. The other insurer’s appraiser is not your only option. Under German damages law the injured party may as a rule commission their own independent expert. Whether you do that is your decision – not the insurer’s.
  7. Call us. We speak English, we usually reach you the same or the next day, and we come to the vehicle – base housing, off-post apartment, shop, tow yard.
  8. Do not have the car repaired before the inspection. Once the damage is gone, it cannot be documented. And an undocumented damage is a damage nobody pays for.

The money question

Who pays for the expert report?

It depends on who caused the accident. There are three honest answers, and we would rather give you all three than the one that sounds best.

The other driver is fully at fault. Their liability insurer normally carries the cost of the independent expert report as part of your damage. In that case, with full settlement, you have no expert fee to pay. We invoice the insurer directly.

Fault is shared or unclear. Then the costs are usually split along the liability quota. This is precisely the situation in which a report is worth the most – because the quota is argued on the basis of the physical evidence, and the evidence disappears with the repair.

You caused the accident yourself. Then your own comprehensive cover (Kasko) applies – a contract, not statutory damages. Your insurer decides who assesses the damage. We can still prepare a cost calculation for you or work on the insurer’s assignment. More in German: Kasko-Gutachten im Detail →

Large POVs, pickups and imported US-spec vehicles are part of everyday work in the Kaiserslautern area – and they raise valuation questions a standard report often gets wrong.

Measured, not estimated

„Prior damage.“ The one word that can cost you everything.

If the insurer wants to reduce your claim, they rarely argue about the law. They argue about the car. The audit report (Prüfbericht) comes back with three sentences, and every one of them is a claim about physical facts: „That dent was already there.“ „This position is not necessary.“ „The damage does not match the accident.“

For an imported US-spec vehicle this hits harder than for anyone else. Your car may have a repair history in Texas that no German insurer can look up – so „prior damage“ becomes a convenient assumption. An assumption is beaten by a measurement. That is our entire job on this page.

Paint thickness gauge (Lackschichtmessung)

Factory paint has a typical thickness, measured in micrometres. A repainted panel does not. We measure every panel and record the profile. That turns „it was already damaged“ into a testable statement – and it works in both directions: it also proves that the fender next to the impact was not repaired before, so nobody can push an old repair onto your claim. Where a filler or a hidden repair is suspected under intact paint, thermography shows it as a heat signature.

Diagnostic testers (Launch, Hella Gutmann)

A modern bumper is not a bumper. It carries radar, cameras and sensors. After the repair, those driver assistance systems must be re-calibrated – and calibration is the most expensive item nobody sees on a photo. We read the fault memory and document the calibration status with the Launch and Hella Gutmann testers, plus an oscilloscope for signal faults in the wiring. Without that documentation, the item gets struck from the invoice.

Our own inspection hall, three lifts

Our hall is a former full car repair workshop, used today exclusively for expert examinations – with three vehicle lifts. When the question is whether the impact reached the subframe, we lift the car and look, and we measure the geometry of the axles. „The damage does not match the accident“ is an easy sentence to write from behind a desk. It is a hard sentence to defend against an underbody inspection.

POV specifics

Why a POV is not just another German car

Your privately owned vehicle sits in a special position, and a standard report often ignores it. Four points come up again and again in our inspections around Ramstein, Vogelweh and Landstuhl.

Registration and plates

POVs of ID cardholders are registered through the US Forces vehicle registration process and carry ordinary German-style plates. They are exempt from German road tax and from the German technical inspection (TÜV). None of that changes your rights as an injured party under German civil law – but it does change which documents we need. Bring the registration, the insurance details and, if you have it, the last safety inspection performed on base.

US-spec vehicles and their value

A Dodge Ram or a Ford F-150 shipped over from the States is not valued at the US price list. What counts is the replacement value on the German market – and that market is thin, which can push the figure in either direction. The same is true for parts: some are shipped in, some take time. PCS – you may be leaving soon

A claim can outlive an assignment. If your PCS date is near, say so in the first phone call. We prioritise the inspection, deliver the report as a rule within one to two working days, send everything as a PDF by email, and keep the file so it can still be used after you have left. Do not let a claim quietly expire because the car was sold and the evidence went with it.

What is in a German expert report – and what it is worth to you

A German Gutachten is more than a repair estimate. It contains several separate money positions, and each of them is a claim you can lose simply by not knowing it exists.

  • Repair cost – calculated with SilverDAT 3, itemised, every position traceable to a documented finding.
  • Diminished value (Wertminderung) – even a perfectly repaired car is worth less on the market because the accident must be disclosed at resale. This is real money, and it is regularly forgotten. In German: Wertminderung nach Unfall →
  • Loss of use (Nutzungsausfall) – a daily amount for the days you had no usable car, even if you never rented one. In German: Nutzungsausfall berechnen →
  • Replacement value and residual value – if repair is uneconomical, the case becomes a total loss and the arithmetic changes completely. In German: Totalschaden verstehen →
  • Photo documentation and findings – the part that survives the repair. It is the only thing that still exists when the argument starts three months later.

What we do not do – said plainly

A company that only tells you what it can do is selling. Here is the other half.

  • We are not lawyers. We do not give legal advice and we do not represent you against the insurer. We document the technical facts and we explain them. For legal questions you need a German attorney for traffic law (Fachanwalt für Verkehrsrecht) – we work with several: unsere Anwaltspartner →
  • We do not repair cars. We assess. Which workshop repairs your vehicle is your decision alone (§ 249 BGB) – we take no commission from any shop, in either direction.
  • We do not decide court cases. If a German court needs an expert, the court itself selects one (§ 404 of the German Code of Civil Procedure) – the yardstick is technical suitability for the specific question, not a title. What we bring is our own qualification: personally certified to DIN EN ISO/IEC 17024, certificate no. 140985, ADA InVivo BV, re-certified every three years.
  • We do not handle claims under the SOFA claims procedure. If your case runs through the claims office rather than through a civil claim against another driver’s insurer, that office is your address – not us.

The expensive damage never shows up in a photo

Two questions decide who pays – and neither can be answered from pictures: why the engine failed, and what the high-voltage battery actually looks like on the inside. Both have to be measured. Here is exactly how we do it, with the equipment named.

Engine damage: cause, not guesswork

Whether an engine failed because of a material defect, a handling error or an earlier repair decides who is liable. We establish that with endoscopy (borescope inspection of the combustion chamber), compression and leak-down testing, and – where the vehicle alone gives no answer – laboratory oil and material analysis. In German this is called a Motorschaden-Gutachten: an engine damage report.

The battery gets a number

On an electric vehicle the battery is the single most valuable component. After a collision we measure its State of Health using the AVILOO battery test and record it as a figure an insurer can verify – not an estimate, and not a referral to the manufacturer.

Qualified — and equipped

Working on a live high-voltage system requires both training and equipment. Our experts hold the German high-voltage qualification level 3S (Stufe 3S), trained at the TAK in Bonn – and every one of our company vehicles carries the complete high-voltage PPE: insulating gloves, a Bosch BIT 1000 to verify the absence of voltage (de-energisation), plus barrier and warning equipment. Which level a given task requires follows from the risk assessment (DGUV Information 209-093).

Control units are read out with Launch and Hella Gutmann diagnostic testers; the oscilloscope then checks whether the signal is telling the truth. A fault code is a hint – not proof.

From the crash to the payment

How the money actually reaches you

When a German driver is at fault, your claim is not settled by your own carrier. It is settled by the at-fault driver's German liability insurer (Kfz-Haftpflicht). You file the claim against that company; a claims representative is assigned to it; and that representative reviews the file and comes back with an offer of compensation. The law of the place where the accident happened applies – German law, whatever passport you hold.

The offer they make is built almost entirely on one document. If your expert report is thin, the offer is thin. If it is complete and every figure is traceable, there is very little left to argue about. That is the whole reason to have your own appraiser instead of accepting theirs.

“But I have USAA.” “But I have GEICO.”

Many drivers in the KMC are insured through USAA's Europe auto policy, through GEICO's overseas programme for military members, or directly with a German insurer. You needed proof of third-party liability cover – the Insurance Confirmation Card, or a German Deckungskarte – simply to get plates on the car in the first place.

Tell your carrier what happened. They are your partner for your own coverage. But when the other driver caused the accident, your carrier is not the one who decides what your damage is worth – the liable insurer pays, and German damages law sets the rules. An expert who is independent of every insurer in the file is worth more to you than one who is not. We are not part of any insurer's network, and we do not work for USAA, GEICO or anyone else on the other side of your claim.

What to have ready when we come

Nothing here is a deal-breaker. If a document is missing, we still inspect – but the more of this you have, the faster the file closes.

  • Your registration document for the vehicle and the mileage.
  • The other driver's licence plate – often that alone is enough for us to start.
  • The police file number and the officer's name, if the police attended.
  • The European Accident Statement you filled out at the scene, if you have it.
  • Your insurance details (policy number, carrier).
  • Receipts for earlier repairs, if the car had any prior damage. This protects you – it is the fastest way to prove that the dent was not there before.
  • Photos you took at the scene, before the cars were moved.

Do I really get to choose my own expert?

Yes. As the injured party you have the right to appoint an independent expert of your choice (§ 249 BGB). You do not need permission from the other driver’s insurer, and you do not have to accept the appraiser they offer. Say the sentence and move on: „I will appoint my own expert.“

Do you speak English?

Yes – on the phone, on WhatsApp and at the vehicle. Multilingual reports are part of our registered DAT Expert Partner profile. The version that goes to the German insurer is the German one; you get the explanation, and on request the report content, in English.

How fast can you look at my car?

We are reachable by phone every day from 06:00 to 22:00 – and you speak directly to a Kfz-Sachverständiger, not to a hotline. Outside those hours an emergency call centre takes your message. Inspection appointments are mobile and arranged individually; the report follows as a rule within one to two working days.

Can you come on base or to base housing?

We are a mobile expert office and we come to the vehicle – off-post housing, a body shop, a tow yard, your workplace. Access to a military installation depends on the rules of that installation and on your sponsorship; if access is not possible, we simply agree on a meeting point outside the gate. That has never yet stopped an inspection.

The insurer already sent their appraiser. Is it too late?

Usually not – as long as the car has not been repaired. The damage is still on the vehicle, so it can still be documented independently. If the repair has already happened, we work with the photos, the invoice and the repair documentation; that is weaker, but it is not nothing. Call and describe the situation.

My car is a US-spec import. Can you still calculate it?

Yes. We calculate with SilverDAT 3 and, where the database does not carry a US-spec variant, we document the vehicle individually – equipment, parts sourcing, and the replacement value on the German market rather than a US list price. That individual documentation is exactly what keeps the figure from being guessed downwards.

What does it cost me if the other driver is fully at fault?

It was only a small scratch. Do I need a full report?
